Terms and Conditions

Version 2026-08-23

Pending owner/counsel review: the sections below are a complete draft matching how our website, customer portal, and facility portal actually work today. They have not been reviewed by an attorney, and nothing here should be read as legal advice or a certification of compliance with any particular law.

Welcome to J & M Logistics Inc. ("J&M", "we", "us"), a provider of non-emergency transportation services, defensive driving courses, CPR training, and related services in Memphis, TN. These Terms and Conditions cover both our website generally ("Website Terms of Use") and the services themselves. By using our website, our customer or facility portal, or our transportation and training services, you agree to comply with and be bound by the following terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using our services, you agree to these Terms and Conditions, our Privacy Policy, and any additional terms and policies that may be posted on our website or communicated to you — including the Facility Portal Terms if you use the facility portal, or the Applicant & Employee Privacy Notice if you apply for or hold a position with us.

2. Website Terms of Use

This website is provided for the purpose of learning about and requesting J&M's services. You agree to use it only for lawful purposes, not to attempt to disrupt or gain unauthorized access to any part of it (including the customer, facility, or employee portals), and not to submit false information through any form on this site. Content on this website — text, images, and design — belongs to J&M or its licensors and may not be copied or reused without permission, except as needed to use the site normally (e.g. printing a booking confirmation for your own records).

3. Services Offered

J & M Logistics Inc. provides Non-Emergency Transportation, Defensive Driving Courses, PASS Training, CPR Training, and other related services. Specific details about each service, including availability and pricing, can be found on our website or obtained by contacting us directly.

4. Payment Terms

All payments for services rendered are due at the time of booking. Online payments made through the customer or facility portal are processed by Stripe, our payment processor — we never see or store your full card number. Submitting a payment does not, by itself, confirm your trip; staff review and confirmation is a separate step (you'll see a distinct status and a separate confirmation once that happens). All payments are final and non-refundable, as outlined in our Cancellation Policy below.

5. Customer & Facility Portal Accounts

Creating a customer account, or using a facility account provisioned for you by J&M, requires you to provide accurate information and to keep your password confidential. You're responsible for activity that happens under your login. Tell us right away if you believe your account has been accessed without your permission. We may deactivate an account that we believe is being misused, has provided false information, or has been inactive for an extended period. Facility staff accounts are also governed by the Facility Portal Terms, which cover the facility's own responsibilities when its staff submit trip requests on behalf of members/patients.

Where this site or a form asks you to type your full name to sign or acknowledge something (a booking, an application, a completed training), that typed name — recorded together with the date, time, and which version of the relevant policy was in effect — is your electronic signature on that specific item, and carries the same weight as a handwritten signature to the fullest extent permitted by law.

6. Cancellation & Refund Policy

If you need to cancel a scheduled service or training session, please notify us at least 24 hours in advance. While we do not provide refunds, we may offer the option to reschedule, subject to availability. Training course purchases made online follow this same policy: seats are non-refundable, but may be transferred to a future session if you contact us at least 24 hours before the scheduled date. If we cancel or are unable to perform a trip you've already paid for, or if J&M staff determine a refund is otherwise warranted, refunds are issued back to the original payment method through Stripe and are recorded in our system, but this remains at J&M's discretion outside of that specific case.

7. Client Responsibilities

Clients are responsible for providing accurate information regarding their transportation needs and any medical conditions that may affect service, and must be ready for scheduled pick-up times.

8. Liability Waiver

To the fullest extent permitted by law, J & M Logistics Inc. shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our services or the inability to use our services. Clients agree to indemnify and hold harmless J & M Logistics Inc. from any claims, damages, or losses arising from their use of our services.

9. Code of Conduct

All clients are expected to behave respectfully towards our staff and other clients. We reserve the right to refuse service to anyone who engages in disruptive or abusive behavior.

10. Privacy

Your privacy is important to us. Our Privacy Policy outlines how we collect, use, and protect your personal information. By using our services, you agree to the terms of our Privacy Policy.

11. Electronic Communications & Trip Alerts Consent

By booking a ride, creating a customer account, or providing us your phone number, you agree that we (or the transportation dispatch system we use to schedule and manage your trip) may contact you by email or text message about that trip and your account — for example, a booking confirmation, a confirmed-and-scheduled notice, a pickup or appointment-time reminder, or an operational update about a delay or change. These are service messages tied to a trip or account you already have with us, not advertising, and we send them whether or not you've opted into anything described in the next paragraph.

Separately, and only if you opt in, we may send additional informational text messages (for example, a general reminder about an upcoming appointment window). Message and data rates may apply. Message frequency varies. You can opt out of these at any time by replying STOP to any text from us, or by contacting us using the information on our Contact page; reply HELP for help. Opting out of this optional category does not opt you out of the trip-specific service messages described above, which are necessary to actually deliver the transportation you've requested. We do not currently run marketing or promotional text campaigns; if that ever changes, we'll ask for separate, clearly labeled consent before doing so, and this section will be updated first.

What this looks like in practice today: email confirmations and account/HR notifications are sent directly by our systems. Trip-related text messages may also be sent by our dispatch/scheduling platform once a trip is confirmed, as a standard part of how that trip is managed — not by a separate marketing tool. Job applicants who apply through /careers/apply may also be added to a recruiting email list for future openings; every such email includes an unsubscribe link.

12. Disclaimer

Estimated rates, pickup windows, and arrival times shown on this website or given by phone are estimates only and are not guaranteed. We are not liable for delays caused by traffic, weather, mechanical issues, or other circumstances outside our reasonable control. Nothing on this website, including course or training content, constitutes medical advice; always follow guidance from a qualified medical professional.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page (with the version date at the top updated); your continued use of our services after a change is posted constitutes acceptance of the updated terms.
